This article focuses on the issues about land planning. Usually the state has the right to draw the land planning. But local government also has the interest in that. Is there any right to draw the land planning for the local government? Somebody says ‘yes’ and others say ‘no’.
The autonomy power is guaranteed to the local government by the Constitution. But it dose not mean that local government has the right to draw land planning in its own territory.
According to the Constitution the local government system is guaranteed by the Constitution. And it cannot be abolished even by the law. So if the land planning is essential to the local government system, it should be granted tht local government also have the power to draw the land planning in its own territory.
