미국행정법학계에 대한 길준규교수의 현황 조사

1. 미국의 행정법학회 여부

- 미국로스쿨에서는 행정법은 선택과목이어서 그다지 인기가 높지 않은 편이어서 학교별로 2-3명의 교수밖에는 전공자가 없는 편입니다. 그나마 이민법, 환경법 등에 치우쳐 있는 편입니다.

- 현재 미국의 행정법학회는 없다고 볼 수 있습니다.

- 다만, 유사한 기능을 하는 학회로는
1) 미국변협 행정법 및 규제실무 분과 Section of Administrative Law & Regulatory Practice, American Bar Association.

1년에 한번 모이고, 한 주제로 30분에서 1시간 반 정도 회의하며, 매우 느슨한 조직을 가지고 있습니다. 회지는 아래의 행정법잡지에 실립니다. 미국변협의 다른 분과회가 매우 열성적인 것에 비하면, 큰 관심없는 모임이라고 합니다.

아래의 두 모임은 주로 실무가를 위한 단체이어서 교수들이 잘 모릅니다.
2) 행정판사회 (Association of Administrative Law Judges, AALJ)

1974년에 일리노이주에 비영리법인으로 설립. 행정판사, 실무가, 교수 등의 단체

1) 행정법잡지 The Administrative Law Review (ALR)

이 잡지에 비교적 저명한 행정법교수들이 글을 싣는 편입니다. 따라서 비교적 중요하다고 봅니다.

3. 교과서

교과서는 스트라우스의 (Administrative Law: Cases and Comments (University Casebook) 가 정평있는 교재입니다. 다만, 2003년 7월판이고 개정이 안 되어서 추록과 함께 봅니다.
