국문초록

 

인간은 도시를 만들고, 도시는 인간을 만든다는 말이 있다. 사람들이 도시를 만들었지만 어쩌면 도시에 거주하는 사람들은 도시의 문화, 특성, 규모, 환경, 건축, 디자인 등에 절대적으로 영향을 받는다는 의미일 것이다. 도시는 사람들이 만드는 살아 움직이고 변화하는 유기체다. 도시는 많은 인간이 일정한 지역 안에서 밀집하여 거주하는 공간이다. 다양한 이유로 도시에 모여 살지만 주된 이유는 산업화 이후 고도성장을 이룩하면서 도시는 급성장을 하게 되었다. 도시로의 인구이동은 자연스럽게 다양한 도시문제를 발생시켰다.

거대도시가 만들어 지면서 주택, 도로, 공공시설, 상업용 건물, 공장 등 다양한 구조물들이 만들어졌다. 인구의 증가와 함께 도시의 지속적 성장은 끊임없이 진행될 수 있다는 긍정적인 생각은 도시재개발, 신도시건설 등으로 이어졌다. 서울과 수도권의 도시는 고밀도화, 광역화 되었고 수도권을 둘러싼 신도시까지 건설되었다.

하지만 도시의 지속적 성장, 확장은 산업구조의 변화에 따른 쇠퇴를 경험하게 되었고, 도시의 인구는 감소하게 되었다. 이른바 도시의 쇠퇴, 저성장의 시대가 도래하기 시작하였다. 이러한 경험은 유럽은 물론 미국, 일본도 1950년대 이후부터 경험하게 되면서 도시개발의 방향성을 변화시키는 패러다임의 변화가 시작되었다. 우리나라도 마찬가지로 1960년대 이후 도시정책에 있어서는 산업화를 토대로 한 고도성장의 기조에 맞게 유지되면서 신도시개발, 주택 및 도시 인프라의 공급 확대가 지속되어 오다가 2008년 글로벌금융위기 이후 경제성장률의 둔화와 함께 인구구조의 변화 즉, 저출산·고령화로 도시개발의 방향성을 변화하기에 이르렀다. 왜냐하면 수도권의 인구집중은 도시의 무질서한 확산을 초래하였고, 나아가서 구도심 및 지방은 인구감소로 인한 도시쇠퇴는 물론 삶의 여건, 환경, 도시기능의 악화로 삶의 질이 현저히 나쁘게 변하게 되었다.

이러한 도시문제를 성찰하면서 도시쇠퇴의 문제를 해결하기 위하여 새로운 도시정책의 패러다임이 도입되었으며 그것이 도시재생이다. 즉 도시재개발, 주택 재건축, 도시 재정비, 신도시 건설 등을 중심으로 한 물리적·공간적 개발이 주를 이루었으나, 침체된 도시의 중심시가지와 쇠퇴지역에 활력을 불어넣기 위한 도시재생이 새로이 조명을 받기 시작한 것이다. 이를 위하여 우리나라는 2013년에 도시재생활성화및지원에관한특별법을 제정하였으며, 동 법에서는 도시재생인구의 감소, 산업구조의 변화, 도시의 무분별한 확장, 주거환경의 노후화 등으로 쇠퇴하는 도시를 지역역량의 강화, 새로운 기능의 도입.창출 및 지역자원의 활용을 통하여 경제적·사회적·물리적·환경적으로 활성화시키는 것이라고 정의한다(2조 제1).

본 연구에서는 도시재생의 이론적 검토와 함께, 도시재생활성화및지원에관한특별법의 입법 배경 및 동 법의 주요 내용, 그리고 도시재생이 도시재생뉴딜이라는 이름으로 지금까지 추진되어 오면서 제기되고 있는 정책적 문제를 해소하고, 지속가능한 도시재생을 통하여 도시재생의 본래의 목적을 달성할 수 있는 도시재생활성화및지원에관한특별법의 개선 방안에 대한 현행 법제의 검토를 하였다.

 

Abstract

 

We say, humans make urban cities and urban cities make humans. Though humans made urban cities, that saying perhaps means the humans residing in an urban area are absolutely affected by the culture, characteristics, size, environment, construction, design, etc. in the urban city. An urban city is a living organism, changing itself, being made by humans. Urban cities are a space where lots of people reside in a dense situation within a certain area. Though they reside in an urban city for a variety of reasons, it is mostly because of the high growth from the industrialization that made the cities grew rapidly. Peoples moving to cities naturally produced various urban problems.

With the urban cities becoming into a mega city, there have made various structures such as houses, roads, public facilities, commercial buildings, factories, etc. With the population increase, they became to have a bright side belief that the sustained growth of cities would continue, which led to urban redevelopment, construction of a new cities, etc. Seoul and its metropolitan area’s cities became high density and wide area-based cities, which eventually led to construction of new cities.

However, the continued growth and expansion of cities finally resulted in decay from change of industrial structure and the urban population began to decrease. So-called urban decay, era of low growth has come. This experience, along with the experiences of USA and Japan, as well as Europe after the 1950s, triggered the change of paradigm that changes the direction of urban development. In Korea, too, urban policies had been maintained in accordance with the high growth based on industrialization after the 1960s, continuing expansion of supply such as new cities development, housing and urban infrastructures. Then, after the global financial crisis in 2008, the direction of urban development was changed along with the slowed economic growth and change of population structure, i.e. low-birth and aging. This is because the population concentration into the Seoul metropolitan area brought about urban sprawl, and further more, the urban decay from the population decrease in the old urban downtowns and local areas as well as the deterioration of living conditions, environments, and urban function substantially aggravated the quality of lives.

Considering on these urban problems, to solve the problem of urban decay, there introduced a new urban policy paradigm - ‘Urban Regeneration’. That is, there had been mainly physical and spatial development focusing on urban redevelopment, house reconstruction, urban reorganization, construction of new cities, etc. However, ‘urban regeneration’, to revitalize the decayed area and downtowns of rundown cities, became to be highlighted. For this purpose, Korea legislated the Special Act on Promotion and Support for Urban Regeneration in 2013, The act defines ‘urban regeneration’ as “economic, social, physical, and environmental revitalization of a city which is declining due to depopulation, change of industrial structure, urban sprawl, deterioration of the dwelling condition, etc. by strengthening local capacity, introducing and creating new functions, and utilizing local resources” (Paragraph 1, Article 2).

This study made theoretical review on urban regeneration and also reviewed on the background of legislating the Special Act on Promotion and Support for Urban Regeneration including the act’s major contents. This study also reviewed on the current legislation as per the strategy to improve the Special Act on Promotion and Support for Urban Regeneration so that urban regeneration can resolve policy issues that have been raised so far with the implementation of Urban Regeneration New Deal and achieve the original purpose of urban regeneration via sustainable urban regeneration.
